SAFETY Act Certification

Tulsa, Oklahoma - June 15, 2011 - Ameristar Fence Products announced today that the U.S. Department of Homeland Security has Designated and Certified the company's Impasse® High Security Pale Fence and Stalwart® Anti-Ram Passive Cable Barrier system under the Support Anti-terrorism by Fostering Effective Technology Act of 2002 (the SAFETY Act). The certification sets Ameristar's Impasse palisade fencing and their Stalwart family of anti-ram cabled barriers on the "Approved Product list for Homeland Security." Certification is the highest level of liability protection available under the SAFETY Act.

Here's a little background information on the SAFETY Act:

  1. The Support Anti-terrorism by Fostering Effective Technology Act of 2002 (SAFETY Act) was enacted as part of the Homeland Security Act of 2002 (Title VIII, Subtitle G)
  2. Intended to facilitate the development and deployment of anti-terrorism technologies by creating systems of "risk management" and "litigation management"
  3. Protections apply only to claims arising out of, relating to, or resulting from an act of terrorism

Also, here are the primary benefits associated with the SAFETY ACT designation and certification:

  1. Creates a system of risk and litigation management
  2. Provides liability protection for our fence installers, architects, engineers, end use customers and security integrators
  3. Affords Ameristar the benefits of "Government Contractor Defense" which limits liability

What does this mean for you? The SAFETY Act provides lawsuit protection and dramatically lower liability exposure for Ameristar and its customers should a future act of terrorism occur. This benefit extends not only to Ameristar and those who install our products, but also to the end customers that use our qualified physical security products on their facilities. In short, the entire supply chain (manufacturers, specifiers, installers, vendors and customers) will benefit from the coverage Ameristar receives from the SAFETY Act Certification.

The SAFETY Act basically eliminates liability that could potentially arise out of a terrorist attack for sellers whose anti-terror products have been reviewed and approved by the DHS in America's fight against terrorism. Most importantly, these lawsuit protections extend to Ameristar's customers should a future act of terrorism occur and lawsuits follow that allege Ameristar's physical security products failed to prevent the terrorism.

In the event of a terrorist attack, our customers' liability would be strictly limited, if nonexistent, in most scenarios because they purchased Ameristar's SAFETY Act approved products. As an added benefit, Ameristar's customers may be able to take advantage of lower insurance premiums given the elimination of lawsuit liability should a future act of terrorism occur. Alternatively, companies that purchase similar products from other manufacturers would not enjoy the benefits of the SAFETY Act protection.
